The ACAS Code for Disciplinary Procedures While dealing with management and resolution of disciplinary issues within an organisation, the ACAS Code on Disciplinary and Grievance Procedures in Employment forms an important source of good practice that is required to be followed. The code takes into consideration the existing provision of the legislative structure applicable in relation to employment laws (Acas.org.uk 2016). Following are the legislations, the provisions of which are incorporated within the code: Trade Union and Labour Relations (Consolidation) Act 1992 Employment Act 2002 Employment Rights Act 1996 Though violating the provisions of the code is, in itself, not unlawful, its provisions play an important role in understanding the disciplinary process. Such breaches of its provisions will not attract legal proceeding. However, employment tribunals consider the code while hearing relevant cases. Arbitrators appointed by the ACAS follow the code to dispose off cases brought under the ACAS Arbitration Scheme (Acas.org.uk 2016). A handbook developed by the ACAS known as the Discipline and Grievance at Work, stipulates the following Code of Practice: The need for disciplinary procedure and rules Proper handling of a disciplinary matter Holding of a disciplinary hearing Deciding and implementing disciplinary actions, and An appeals process Fair Disciplinary Procedure Section 1 of the Employment Rights Act 1996 states deals with an employees right to a statement of employment particulars. This is considered to be the starting point of a disciplinary process (Legislation.gov.uk 2016). Section 3 further stipulates that the statement of particulars be required to include disciplinary rules applicable to an employee. The Employment Act 2002 states that the statement shall also contain the procedures applicable while taking disciplinary actions. Section 98A of the Employment Rights Act 1996 stipulates a three-step dismissal and disciplinary procedure as follows (Legislation.gov.uk 2016): Step 1: The employer must communicate to the employee about the employees conduct, capability or other circumstances that may result in a disciplinary or dismissal action. Step 2: A meeting should be convened at a reasonable time and place where the matter can be discussed with the employee. Step 3: If the employee wants to appeal, he/she should communicate it to the employer. The employer may hold further hearings to resolve the matter. Key Components of Disciplinary Process According to the ACAS code, following are the key components of a disciplinary process (Acas.org.uk 2016): An oral warning Followed by a written warning if there are no improvements A final written warning if the conduct or capability of the employee is still not satisfactory Convening of a hearing Ultimately dismissal if the matter is not resolved or if improvements are not noticed As it has been explained earlier, that the employee is required to be given a fair opportunity of being heard. The management faces a number of challenges as stipulated below: Regulatory provisions being stringent, an organization has to follows procedural steps even if the employee is found to be in cross misconduct and of unsatisfactory performance. Often the employees do not attend the meetings and hearings. This extends the whole procedure and the organisation has to incur losses. The employees against whom the company has initiated a proceeding often ignore the arbitration process (Code of professional conduct and disciplinary procedures 2016). In case, where the employee is required to get a statement of particulars and other essential documents, the witnessing process is hampered as witnesses often refuse to be identified. The organisation is legally and ethically bound by the code and legislative provisions to conduct a fair disciplinary procedure. This intent of the organisation often is misjudged by the employees and as a result, the entire process turns out be chaotic. While implementing a disciplinary procedure, an organization faces much resistance from the trade unions (Xperthr.co.uk 2011). Case Laws The legislative structure intends to prevent unfair dismissals by employers. The legislation requires the organisations to act reasonable and this element has been the core of the entire structure. This changed the manner in which witnessing is done in employment trials. The company selected for this part of the report is Tesco PLC. Tesco has profound disciplinary procedure that it follows which is in parity with the ACAS code and the applicable legislative framework (Acas.org.uk 2016). The company encourages its employees to maintain its standards of conduct and capability so that the overall goals of the organisation are achieved. In case the performance or behaviour of an employee is in question, the line managers take up the responsibility and work closely with the employee to improve his/her condition (Our Code of Business Conduct - Tesco 2016). The company has in place two disciplinary procedures: Informal Procedure, and Formal Procedure Formal procedure is only availed when all efforts of the company through the informal procedure has been exhausted (Solving Problems at Work Staff Guide - Tesco 2016). The company is committed to conduct a thorough and fair investigation in order to address the issues identified. This investigation is generally concluded within a reasonable timeframe of 14 days unless both the parties agree for an extension. Informal Procedure The line manager deals with the employee first hand whose conduct and capability is in question and will try to resolve the matter. This working together attempts to solve all the issues identified informally and bring back the conduct and capability of the employee to the required level (Solving Problems at Work Staff Guide - Tesco 2016). Effective coaching and support is given to the employee to resolve the issues. At this stage, all the required information is communicated to the employee and every step is taken with the approval of the employee. Formal Procedure If issues are not resolved informally and the situation becomes serious, the manager takes the formal disciplinary procedure. The formal procedure of Tesco consists of the following stages (Solving Problems at Work Staff Guide - Tesco 2016): Verbal Warning First Written Warning Final Written Warning Suspension/Demotion/Dismissal If all attempts to solve the issues fail and the performance of the employee is still unsatisfactory, Tesco takes either of the following actions (Solving Problems at Work Staff Guide - Tesco 2016): Suspends the employee or Demotes him/her or Ultimately dismisses the employee. It can be seen that Tesco follows a well organized disciplinary procedure to resolve employee issues. In the given case law, the employee was not communicated all the material facts of his case, which ultimately lead the EAT to decide that the dismissal was unfair. However, the procedure of Tesco allows all representations of the employee and provides an explicit right to appeal against the disciplinary actions taken against the employee (Tesco direct 2016). Relation with other Company HR Policies As explained above, Tesco has a well written and structure disciplinary procedure and the company takes serious note of each and every employee issue. It is a multinational company and consists of employees who come from different ethnic backgrounds. Companies are actively adhering to employment laws in order to resolve issues related to conduct and capabilities of their employees. A proper mechanism to resolve these issues ultimately saves valuable resources of the company. To achieve this, every company is required to handle sensitive employment matters fairly and with justice by providing all the required information to the employee in question. It made his poetry more effective and more enjoya ble to read. Another technique Frost used was the dramatic technique of dialouge. This also improves the effectiveness of his poems, since people come to life when they speak their own words. When reading his poems the yankee phraseology makes us feel like we are in the heart of New England. Nature figures into everything that Robert Froat wrote. In one of his most popular poems after Apple-Picking, Frost wrote of a farmers view of the afterlife. His simple idea states that this old farmer's heaven will be a dream of the activities which made up his life. Although his poetry was filled with disciplined and refined language, made to serve the poetic purpose, he never failed to write simply. In conclusion, Frost like many other poets used traditional forms, and spoke in Yankee idiom, but there was so much more to him. While working in rural seclusion, Frost succeeded in simplifying his language and keeping to his form. His work constrasted with many othe major American poets during hi s time. These ten words have shifted their senses over the years. In some cases, we are wise to likewise be flexible; in others, we relax our vocabulary at the expense of useful distinctions: 1. To others this is unfair as the employees who also contributed massively to the success of the company get very little in return. Again, European CEO’s earn three times lesser what the CEO’s in U. S earn despite their having similar qualification. According to pay analysts the high salaries could have rose due imperfections in the market place. CEO salaries are determined by Board Committees, which fail to link performance with the salary awarded. This allows for great variance in the salary scales of workers. Consultancy firms that advice such committees on how much to pay the CEO are also a factor contributing to hefty CEO salaries. Hefty CEO salaries do not translate to better performance. The company shares could be declining due to customer dissatisfaction despite them spending so much money on CEO’s pay. Workers pay remain very low even after the federal increment of the minimum wage however this is like a drop in the sea as when adjusted for inflation it is still 7% below where it was 10 years ago. People should just be cautious not to use others as mere means to an end but as ends in themselves. Using someone as a mere means implies that the person’s consent is not sought. (Onora, 219) People can be used as mere means by deceiving them; using false pretenses or giving misleading account at their expense. Coercion can also be used in using people as means to an end. Justice, to Kant entails not acting on maxims that use others as mere means to an end. Duties performed should be beneficial even to the people used in attaining the goals. Kantian approach does not focus a lot on the outcomes of an act but on the intentions. Sometimes good intentions could result to bad results. Human beings are rational beings with the ability to choose and plan and consequently should not be used as mere means in attaining happiness or goals in life. Kant emphasizes on cosmopolitan justice where justice is felt at a global level. His approach allows respect for human rights and also encourages cultural diversity. (Onora, 218) Sartre explains how we live in a society full of oppression and exploitation. He tries to create a responsible nation. People have different egos and should be controlled by their consciousness in doing their actions Sartre was an atheist who believed that God doesn’t exist. He devotes concerns to emotion as a spontaneous activity of consciousness that is projected onto the real world. To him people use their free will in partaking their actions and this poses the danger of people not being ready to take responsibility for their deeds. The society is full of hostility of man towards his fellow men. Sartre coins Marxist theory and states that ‘man is nothing else but that which he makes of himself’. The ultimate responsibilities of man are to first form himself then have social responsibility to help society. â€Å"Man can will nothing unless he has first understood that he must count no one but himself; that he is alone, abandoned on earth in the midst of his infinite responsibilities, without help, with no other aim than the one he sets himself, with no other destiny than the one he forges for himself on this earth† (Being Nothing 1943). Aristotle would see the high salaries of CEO as justified. This is because the CEO’s have established what they want in life and have worked hard to achieve it. They may have acquired appropriate education and professional skills that is required in the demanding CEO Job. This can be seen as the sharpening of a knife used for cutting objects. The good pay rewards their hard work and they attain happiness, which is very vital in human beings life. CEO’s have moral virtues as they find pride in what they do using the liberal means. They do not unjustly gain as they have what it takes to be in the CEO’s position. Just like other human beings, the CEO’s can reason but can do it better no wonder they get such positions. The workers should be challenged to improve on their skills to enable them become better people in society. However, Aristotle would consider CEO’s who earn hefty pay but fail to perform as being unjust. This could be attributed to the fact that the equilibrium or balance required between the good is not attained. Giving too much to the CEO’s and very little to the workers despite their hard work in itself a form of injustice. However, CEO’s can be justified with their hefty salaries because they have the appropriate knowledge and wisdom to lead companies to great heights in society. To him virtue is about proper functioning of something and consequently things should work properly for that which they are meant to do. CEO’s should earn enough salary to justify what they are worth. To Kant, hefty salaries for CEO’s would be a normal scenario in the society. This is because in society people have different ‘maxims’ or purposes for which they intend to satisfy. The only point of concern to consider when satisfying this maxim is to make sure one does not use others as mere means to an end. Although CEO’s have hefty wages they strive to attain what it takes to be in such positions. Again they do not use workers as mere means to an end but as ends to themselves. This is attributed to the fact that the workers gain in this arrangement. The CEO’s ensure good management of the organization or company, which translates to increased profits, and survival of the firm. Without these the companies would close down and the employees or workers too, would lose their jobs. Since the workers are aware of the situation then it is all right. (Lewis et al, 40) In most cases, the CEO’s do not use false pretenses of what they are doing. They provide clear guidelines of the company’s or firms. Again they do not use any form of coercion or use misleading accounts at the expense of the workers. Their wages are therefore justified as the good intentions, which are of much importance that lead to bad results. Workers work harder at the ground but the pay does not match the hard work. To Kant, human beings are rational and have the free will to plan not be exploited by being used as mere means to an end. Workers can choose and plan to develop their skills, which would see them in higher positions in society. Higher positions translate to better pay and a good life in general. Hefty salaries for CEO’s according to Sartre would be another form of exploitation, which is common in society. The society is full of individuals who are out to take advantage of their fellow individuals. CEO’s have an ego that shows they are very prominent and important in the society as well as in the companies they work for. Consultation firms that work to ensure the salaries are high also share that feeling. This feeling that CEO’s deserve hefty pays ensures that the salaries remain high at the expense of the workers who work more. Sartre would see the lack of corporate social responsibility on CEO’s to their workers. Human beings are what they choose to be and they have the freedom at their disposal. CEO’s choose such positions and pursue all that entails being there but they should show some responsibility to society by ensuring that the workers salaries are increased. Earning what someone else in the same company or firm would earn in a whole year is a high degree of oppression. On the contrary workers contribute to their oppression by not airing their grievances like demonstrating against the hefty CEO’s wages. Man is nothing without mutual responsibility and consequently responsibility should be instilled in the CEO’s minds. They can reduce their salaries and work to improve the workers welfare by increasing their salaries. Sartre is close in explaining my view that CEO’s should not be earning in a day what a worker earns in a whole year. Workers perform most of the work and rewarding their efforts will be appropriate. It will act as an incentive to work. Motivated workers produce quality work, which would lead to increased profits. CEO’s should not be too selfish in feasting on the largest piece of cake. They should show some responsibility which is part of what makes a human being by ensuring reduced salaries on their part while increasing the workers pay (Thomas, 150) The role of the workers in an organization cannot be underestimated. Despite good management from the CEO the workers should work under conducive environment. For firms to thrive, workers are involved at the grass root level in implementing of policies. Mere formulation without implementation is useless. Equality can be maintained by following the pay on performance approach where both CEO’s and workers are encouraged to work for the benefit of the whole firm or organization. Workers should unite in fighting for fair or justice in pay. CEO should not be paid hefty pay at the expense of workers. Appropriate measures should be taken to ensure that workers are not exploited. Closing loopholes on taxes that allow companies to deduct, as much money as they please should be observed. Compensation should be done with relation to performance and increment in pay should be justified. Introducing progressive taxes can work to reduce the amount of money CEO’s take home as salaries. Limit should be made on the amount of money CEO’s can take as their retirement plans. This will reduce the hefty amount of money CEO’s take home on retirement.

Emily is sitting in the park thinking about the argument she had just had with her mum and how she didn’t mean anything she had said to her. She all of a sudden realised the time â€Å"oh no I’m ten minutes late now mum will be even more annoyed with me† she says. Emily quickly starts to run home trying not to run into people or things. She arrived home but to her amazement there isn’t an angry mum waiting to tell her off at the front door. â€Å"Mum† Emily shouts â€Å"mum† but there was no reply so she shouts again â€Å"mum are you there†. Emily starts to look around the house but she can’t find her anywhere â€Å"ok then if she’s not here there will be a note† thinks Emily. So she begins looking for a note but there isn’t one anywhere. Emily then spots something on the floor â€Å"what’s this† says Emily. To her surprise it was her favourite book on the floor â€Å"I’m sure I didn’t leave this here† says Emily confusedly. Emily picks up the book and looks at the open page and there was her mum in the picture on the page and in shock she drops the book on the floor. Then Emily remembered the story in her book about the pixie king who desperately wanted a wife and who had a secret labyrinth. Emily starts crying and mutters to her self â€Å"why my mum out of all the people he could pick why my mum. When she had finished crying she turned around and there was the pixie king staring at her and laughing. â€Å"What have you done with my mum?† she cries. â€Å"If you really want to know ill take you there just close your eyes† says the pixie king. Emily closes her eyes. Emily opens her eyes and finds her self in a dusty field where all the grass is dead and in the distance she spots at the entrance of a labyrinth. The pixie kind returns and says â€Å"your mum will be turned in to my wife and will forget you and everything unless you get there in time which you wont,† laughs the pixie king. The pixie king vanishes â€Å"well how hard can it be† says the pixie king. The pixie kin g then reappears and says â€Å"oh and one last thing you have till 12:00 to get to my castle and give your mum this apple it will be too late†. Emily take the apple he gives her and as soon as she takes it he vanishes. â€Å"First I need to get to the labyrinth,† thinks Emily and she starts her walk to the labyrinth. Finally Emily arrives at the gates of the labyrinth â€Å"well this is it† Emily says worriedly and with a big deep breath Emily enters. Emily gives a sigh of relief â€Å"this isn’t so bad† Emily says. The labyrinth is brightly a colour and everywhere she looks there is different types of berries. â€Å"Yum just what I need† Emily says in delight. She reaches out for some strawberries. â€Å"NO NO NO don’t eat them do you have no common sense† says a voice from no where â€Å"Hello who said that† shouts Emily. Out of nowhere a pink and purple butterfly appears and says â€Å"it was me† â€Å"you can talk† says Emily in shock â€Å"of course I can talk says the butterfly†. â€Å"Fine then but I do have common sense and I know that when your hungry your suppose to eat† â€Å"oh you must be new around here I’m Pippy. You can’t eat those berries they make you forget,† says the butterfly. â€Å"Hello I’m Emily and thank you† thanks Emily. â€Å"One last thing how do you get to the pixie kings castle† asks Emily â€Å"well first you go left and I’m really sorry but you’ll have to work out the rest because I don’t want the king after me but if you ever need help just call, bye† says pippy and fly’s of. Emily follows pippy’s instructions and goes left. Emily then notices that every single path she takes is a different colour. Emily continues walking and when she turns the corner she hears an â€Å"oww†. She looks down and notices a worm wearing a black jacket and a top hat â€Å"this place just gets stranger and stranger† mutters Emily. â€Å"I’m not weird and you just kicked me which hurt† shouts the worm â€Å"I am very sorry† apologises Emily â€Å"are you ok† â€Å"yes yes I’m fine, I’m wiggle† replies the worm. â€Å"Hi wiggle, I’m Emily† says Emily â€Å"do you know the way to the castle† asks Emily â€Å"yes you go left and follow the path† says wiggle â€Å"thank you† says Emily thankfully. Emily turns left and follows the path. Emily arrives at the end of the path but she comes across a dead end. â€Å"Well that’s great,† she says. A voice from nowhere then says, â€Å"well you shouldn’t trust strangers† Emily turns around and sees wiggle. â€Å"Why would you do that† Emily says Shockley â€Å"well I couldn’t really tell you the way, I mean who knows what the pixie king would do to me but I’m telling you it wouldn’t be nice?† says wiggle. â€Å"Fine then I’ll do it by my self, GOOD BYE† shouts Emily. Emily goes back down the path and turns the corner and she sees a little pixie wearing a red and green outfit jumping on ladybirds. â€Å"Hey stop† Emily shouts at him â€Å"why should I there horrible things† replies the pixie. Emily picks up the ladybird, the ladybird pricks her. â€Å"Oww it pricked me† she drops the ladybird. â€Å"Well what do you expect† the pixie says â€Å"well not that† says Emily. â€Å" Who are you any way† asks Emily â€Å"who me† says the pixie â€Å" I don’t see any one else around† says Emily â€Å"oh I’m pixel† replies the pixie. â€Å"Please can you help me get to the castle† asks Emily.
